1. ONE COMPETITION, ONE STANDARD

Organizer. The SHAIKE Film Festival is organized by Firstdraft Media SARL, a French limited liability company registered with the Paris Trade and Companies Register under number 812 774 156, with its registered office at 32 rue Étienne Dolet, 75020 Paris, France, operating under the SHAIKE name and brand.

Festival Positioning. SHAIKE is the first contemporary film festival to bring traditional and AI-assisted cinema into the same competition, judged by the same jury under the same criteria. There are no AI categories and no traditional categories. There is only cinema.

One Competition Standard. Films are entered by format (what kind of film it is) and judged on craft, story, and emotion (how good it is). The tools used to make a film, whether a camera, an animation suite, or a generative model, have no bearing on which category it enters or how it is judged. We believe this distinction is already dissolving, and that the films of the coming years will simply be films. SHAIKE judges them as such.

Skill-Based Competition. The Competition is a skill-based film competition. No winner is selected by chance, random draw, lottery, sweepstake or any automated random process.

Entry Fees and Scoring. Entry fees are administrative submission fees. Payment of an entry fee does not purchase any chance of winning, any preferential treatment, or any scoring advantage.

2. AWARD ARCHITECTURE

Award Architecture. The competition is built as a pyramid. Every selected film competes for its format award. Above all format awards sits the Grand Prix, the single highest honor of the festival.

Award Summary. In summary: 10 awards may be granted: 1 Grand Prix, 8 Format Awards and 1 Student Award presented by the city of La Ciotat. Les lumières de l’Eden and La Satis. Every film in the Official Selection is automatically eligible, regardless of format. The jury selects the single finest work of the entire festival, the film that best represents where cinema stands and where it is going. A feature, a documentary, or even a music video can all win it. It is awarded once. It is the focus and the symbol of the whole festival.

Format Awards. Each film enters one format category.

Awards and Benefits. Awards are honorary distinctions unless expressly stated otherwise. Awards have no cash value, are non-transferable, non-refundable and non-exchangeable. The entrant is solely responsible for any tax, social security, customs, reporting or regulatory obligation arising from any award, prize, benefit, invitation or promotional opportunity.

Prize Pool: Prize Pool will be announced throughout the competition according to the upcoming sponsors with a minimum $5.000 USD (five thousand) for the Grand Prix. Each winner in each categories will be screened at Eden Theater, oldest running cinema in the world.

Student Award. One special award, presented by the city of La Ciotat. Les lumières de l’Eden and La Satis. It honours the best student film of the selection and recognizes the next generation of filmmakers. Open to works between 1 and 5 minutes by creators enrolled in an educational institution at the time of the film’s completion (see Section 4). Student films must follow the theme “La Ciotat, birthplace of Cinema”. Student films also compete in their format category.

3. ELIGIBILITY

Completion Date. Films must have been completed on or after 1 January 2025.

No Festival-Specific Requirement. Films do not need to have been made for SHAIKE. Completed, existing works are welcome.

Any Origin of Tools. Traditional, AI-assisted, hybrid, or fully generative works are all eligible and compete on equal terms.

No Nationality Restriction. The festival is international. Films in any language are accepted; films whose dialogue is not in English must carry embedded English subtitles. The Competition is international and governed by French law. Each entrant must ensure that their participation is lawful in their country. SHAIKE may refuse, suspend or cancel any submission that creates a legal, regulatory, tax or sanctions risk outside France.

Age and Capacity. Entrants must be at least 18 years old and have full legal capacity to accept these Rules. A legal entity may submit a film through an authorized adult representative. A student film created by a minor may only be submitted by a parent, legal guardian, school, university or authorized adult representative. SHAIKE may request proof of age, identity, authority, enrolment or legal representation at any time.

One Category Per Film. Each film is entered into the single format that best fits it’s category. The festival reserves the right to reassign a film to a more appropriate category.

Rights and Clearances. The person submitting must hold, or be authorised by the rights holders to grant, the rights needed to enter, screen, promote and license the film under these Rules, including all music, footage, image rights, voice rights, AI-generated material and third-party material (see Sections 10, 11, 12 and 15).

Transparency. Any film that used AI at any point in its creative process completes the SHAIKE Index, a short declaration of the tools and methods used (see Section 9). The Index has no bearing on judging.

Excluded Persons. Members of the jury, members of the pre-selection committee, SHAIKE employees, SHAIKE officers, and persons directly involved in the organization or administration of the Competition may not enter the Competition. Films in which any such person has a material creative, financial or production interest are not eligible.

4. STUDENT ELIGIBILITY (STUDENT AWARD)

Student Eligibility. A film qualifies as a student film if its principal author was enrolled in a school, university, or recognized training program at the time the film was completed. Proof of enrolment (student card, certificate, or letter) may be requested before the award is confirmed. Student films also compete in their format category.

5. SUBMISSION WINDOWS, RUNTIME & FEES

Submission Period. Submissions open 6 July 2026 and close September 6 2026. Fees rise across three windows to reward early entries.

Entry Fees

Standard Fee Categories. * Standard applies to Short Film, Documentary, Music Video, Animation, Commercial / Advert, TV Pilot, and Short Drama.

Entry Fee Terms. Entry fees are stated in euros. Unless expressly stated otherwise, entry fees include applicable French VAT where required by law. Any bank fees, currency conversion fees, payment service fees, chargeback costs or taxes due in the entrant’s jurisdiction are borne by the entrant. Entry fees are non-refundable once the submission has been validated, including in case of non-selection, withdrawal, category reassignment, technical failure attributable to the entrant, ineligibility, breach of these Rules or disqualification. For entrants acting as consumers, submission validation constitutes an express request for immediate performance of the submission review service before the end of the withdrawal period. The entrant acknowledges that, once the submission review service has been fully performed by SHAIKE, the entrant loses the right of withdrawal in relation to the corresponding entry fee, to the extent permitted by applicable consumer law.

Free for SHAIKERS. Every entry fee is waived for members of the SHAIKE community. Membership is subject to approval for AI filmmakers showing outstanding artistic quality. To join, see shaike.ai/join-shaike. The SHAIKERS fee waiver applies only to creators approved by SHAIKE before submission. Submissions all ready paid before becoming a SHAIKER will not be reimbursed. SHAIKE may refuse or withdraw the fee waiver in case of false declaration, duplicate account, misuse of the SHAIKERS status or non-compliance with the SHAIKE community requirements.

Runtime Limits and Tolerances. Runtime is measured from the first frame to the last, including all titles and credits. The stated limits are binding and verified at submission. A tolerance of plus or minus 5 percent is allowed against any stated minimum or maximum. Films outside the stated range, after tolerance, may be reassigned to a fitting category or declined (see Section 13). Filmmakers are responsible for submitting a compliant cut; the festival does not edit submitted works.

Runtime Compliance. Runtime compliance is assessed at SHAIKE’s sole discretion, based on the file submitted at the relevant stage. SHAIKE may reassign, refuse or disqualify any film that does not meet the applicable runtime, format or category requirements. No reassignment, refusal or disqualification based on runtime, format or category gives rise to any refund, compensation or claim.

6. COMMERCIAL / ADVERT: SPECIFIC TERMS

Commercial / Advert Eligibility. The Commercial / Advert category is reserved for real campaigns only: work commissioned by a client and/or aired commercially. Spec ads and concept films made without a client are not eligible in this category.

Commercial Rights. Because commercial work carries brand and client rights, the submitter must warrant that they hold, or are explicitly authorized to grant, the rights to enter, screen, and promote the film at the festival. SHAIKE may request written confirmation from the rights holder before selection is confirmed.

Commercial Authorization. For the Commercial / Advert category, the entrant warrants that the client, brand, agency, producer and all relevant rights holders have authorized the submission, screening, promotion and award consideration of the film under these Rules.

Written Confirmation. SHAIKE may require written confirmation from the brand, client, agency or producer before confirming selection.

Failure to Provide Confirmation. Failure to provide such confirmation within the required deadline may result in refusal, disqualification or withdrawal of the film.

7. HOW TO SUBMIT

Submission Platform. Submit via the shaike platform at https://shaike.ai/event/shaike-film-festival/ in the relevant format category or via Film Freeway: https://filmfreeway.com/shaikefilmfestival

Video Link. Provide a link from Vimeo (set to unlisted and enabling download) or YouTube (set to unlisted). The link must remain live and/or downloadable through 31 October 2026.

Submission Information. Provide: director’s full name, country, email, phone number, film title, synopsis, production credits, runtime, category, and film poster.

Submission Accuracy. All information provided at submission must be accurate, complete and up to date. The entrant must promptly notify SHAIKE of any change affecting eligibility, rights, clearances, contact details, technical access or the accuracy of the SHAIKE Index.

Subtitles. Films whose dialogue is not in English must include embedded English subtitles.

SHAIKE Index Declaration. If AI was used at any point in the creative process, complete the SHAIKE Index declaration (see Section 9).

Clickwrap and Evidence. The Rules have contractual value. Submission is valid only if the entrant has accepted these Rules and the SHAIKE Terms of Use, and has acknowledged the SHAIKE Privacy Policy, by ticking the required boxes on the submission platform. The entrant agrees that electronic acceptance, timestamps, submission logs, payment records and platform records constitute admissible evidence of acceptance, acknowledgement, submission, payment and contractual formation. The contract between SHAIKE and the entrant is formed when the entrant validates the submission process.

Technical Delivery. If a film is selected, the entrant must provide a final screening file within the deadline communicated by SHAIKE. The final screening file must meet the technical specifications reasonably required by SHAIKE, the venue, the projection provider or the broadcast platform. Failure to provide a compliant file within the required deadline may result in withdrawal from the Official Selection without refund or compensation.

8. SELECTION & JUDGING

Three Stages. All eligible submissions progress through three stages: the Official Selection (top 10 by categories), the Finalists (top 3), and the Winners.

Pre-Selection. All submissions are reviewed by the SHAIKE Selection Committee, which curates the Official Selection: up to ten (10) films in each category. Each Official Selection film earns the SHAIKE Film Festival Official Selection laurel.

Finalists. From each category’s Official Selection, the Selection Committee designates up to three (3) films as Finalists. Each Finalist earns the SHAIKE Film Festival Finalist laurel.

Winners and Grand Prix. The SHAIKE Jury judges the Finalists and designates one (1) Winner in each category. From among the category Winners, the Jury designates a single recipient of the Grand Prix SHAIKE. The student Award Presented by the city of La Ciotat, les lumières de l’Eden and La Satis is designated by the La Ciotat Jury from among eligible student films. Winners are revealed live on stage on 2 October 2026.

One Competition, Same Criteria. Every film competes is judged against the same criteria, whatever its format, technique, or origin, with no separate tracks or categories based on the tools or methods used to create it:

– Story & Emotion. The power and clarity of what the film says and makes us feel.
– Craft & Direction. Command of the medium, coherence of vision, execution.
– Originality. Freshness of idea, voice, and form.
– Impact. The lasting impression the film leaves.

Maximum Selection. “Up to” means a maximum number and does not oblige SHAIKE to select the stated number of films in any category.

Selection Flexibility. SHAIKE may select fewer films, merge programming slots, decline to announce Finalists, withhold an award, cancel a category, or award special mentions where the entries do not meet the festival standard or operational requirements. Special mentions carry no monetary prize unless SHAIKE states otherwise.

Eligibility and Disqualification. Advancement at every stage is conditional on the film meeting all eligibility, rights, and consent requirements. SHAIKE may disqualify a film at any stage, including after selection, nomination, or award, if it is found to breach the rules, and may reclaim any award, laurel, or prize awarded.

Tie-Break. In case of a tie, the Jury may deliberate further and decide by majority vote. If no majority is reached, the Jury President has the casting vote. At the Committee stage, selection is by simple majority, with the Festival Director resolving any deadlock.

Final Decisions. All decisions of SHAIKE, the Selection Committee and the Jury are final and not subject to appeal. No entrant is entitled to individual scoring, ranking, deliberation records, jury comments, or reasons for non-selection.

Jury Changes. SHAIKE may appoint, replace, or remove any Selection Committee member or Jury member at any time.

Conflicts of Interest. Where SHAIKE identifies a material conflict of interest, the concerned person may be excluded from reviewing or voting on the relevant film. A conflict of interest does not invalidate the Competition, the Official Selection, or any award unless SHAIKE determines that it materially affected the result.

9. THE SHAIKE INDEX

SHAIKE Index Purpose. In the spirit of judging cinema on its merits while honoring transparency, any film that used artificial intelligence at any point in its creative process completes the SHAIKE Index, a short declaration of the tools and methods used to make the film, recorded as a neutral statement of the tools and techniques used in production. The Index has no bearing on judging. It exists to set an industry standard for honest disclosure, so that how a film was made is a matter of record rather than suspicion. A materially false declaration, including a failure to declare the use of AI, is grounds for disqualification under Section 13.

AI Tools Identification. The SHAIKE Index must identify the main artificial intelligence tools, systems or models used in the creation, development, production or post-production of the film.

AI Use Disclosure. The SHAIKE Index must indicate, where applicable, whether artificial intelligence was used for scriptwriting, visual generation, animation, editing, voice generation, voice cloning, music, sound design, subtitling, translation, enhancement, restoration or post-production.

Supporting Information. SHAIKE may request reasonable supporting information regarding the SHAIKE Index.

Publication. SHAIKE may publish all or part of the SHAIKE Index for transparency, editorial, archival, educational or industry-reporting purposes.

False Declaration. A materially false, misleading or incomplete SHAIKE Index may result in refusal, disqualification, withdrawal of selection or withdrawal of an award.

AI Act / Synthetic Content. The entrant warrants that any AI-generated, AI-manipulated or synthetic content included in the film complies with all applicable transparency, disclosure, labelling, watermarking, metadata and provenance obligations. The entrant must not remove, alter or conceal any lawful technical marking, watermark, metadata or provenance information required by applicable law or by the terms of the AI tools used.

No AI Training. These Rules do not authorize SHAIKE, its partners, sponsors or platforms to use submitted films, images, voices, likenesses, prompts, production files or SHAIKE Index declarations to train generative artificial intelligence models. Any such use requires the entrant’s separate, prior and express written consent.

10. CONSENT, LIKENESS & DEPICTION OF REAL PERSONS

Identity Protection. Protecting the identity, image, and voice of real people is a condition of entry, and applies equally to traditional and AI-assisted work.

Written Consent Required. No film may use the appearance, likeness, voice, or recognizable identity of any real person, living or deceased, public or private, whether captured, recreated, or generated by artificial intelligence, without that person’s prior written consent (or that of their estate or legal representative).

No Unauthorized Digital Replicas. Synthetic or AI-generated recreations of a real person’s face or voice (“digital replicas” or “deepfakes”) are not permitted without documented consent. This reflects current law on the right of publicity and image rights, including the EU framework and applicable national statutes.

No Deceptive or Harmful Use. Films must not use a real person’s likeness to deceive, defame, impersonate, or place that person in a false or damaging context, and must never depict any real person in sexual, intimate, or degrading content without consent. Non-consensual intimate imagery is strictly prohibited and will be reported where required by law.

Proof of Consent. SHAIKE may request written proof of consent or release before selection is confirmed. The submitter bears full responsibility for these clearances and indemnifies the festival under Section 12. SHAIKE may request copies of releases, authorizations or chain-of-title documents at any time.

Rights Clearance. The entrant is solely responsible for obtaining and retaining all authorizations relating to image, voice, name, likeness, performance, biography, privacy, publicity rights and personal depiction. This obligation applies to actors, performers, interviewees, extras, documentary subjects, public figures, private persons, deceased persons, minors and any person whose identity is recognizable.

Minors. For minors, consent must be obtained from the child’s legal representative where required by applicable law.

Documentary/Public Footage. Documentary status, newsworthiness, public-space filming or artistic purpose does not release the entrant from clearing all rights, consents and legal bases required for screening, promotion and platform use under these Rules.

11. CONTENT STANDARDS

Content Standard. SHAIKE welcomes bold, challenging, and provocative cinema. Difficult themes, when treated with artistic purpose, are part of the art form and are not prohibited by this section. What follows concerns content that is unlawful or gratuitously harmful, not subject matter.

Prohibited Content. The following are not permitted and are grounds for refusal or disqualification:

• Illegal Content. Any material that is unlawful under French or applicable international law.
• Child Protection. Any sexualized depiction of minors, real or synthetic, in any form. This is absolutely prohibited and will be reported to the competent authorities.
• Hate and Incitement. Content promoting hatred, discrimination, harassment, or violence against any person or group on the basis of origin, ethnicity, religion, gender, sexual orientation, disability, or any protected characteristic.
• Gratuitous Violence or Graphic Harm. Extreme, gratuitous, or real depictions of violence, cruelty, or self-harm presented without artistic context.
• Explicit Sexual Content. Pornographic or sexually explicit material. Nudity with clear artistic intent may be admitted at the festival’s discretion and may affect programming and age classification.
• Incitement to Illegal Acts. Content that promotes terrorism, or instructs or encourages serious criminal activity.

Programming Discretion. The festival programs a public, in-person event and reserves sole discretion over what is suitable for screening, including age classification and scheduling. A film may be admitted to competition yet placed in a specific programming slot for content reasons.

12. WARRANTIES & INDEMNITY

Warranties. By submitting a film, the entrant represents and warrants that the entrant has full authority to submit the film and accept these Rules.

Rights Authorizations. The entrant represents and warrants that all authors, co-authors, directors, producers, performers, composers, musicians, editors, technicians, brands, clients, agencies and rights holders have granted all rights and authorizations required for the uses permitted under these Rules.

No Third-Party Rights Infringement. The entrant represents and warrants that the film and all submitted materials do not infringe any copyright, neighboring right, trademark, design right, trade secret, image right, voice right, privacy right, publicity right, moral right, contractual right or other third-party right.

No Unlawful Content. The entrant represents and warrants that the film does not contain unlawful, defamatory, hateful, discriminatory, misleading, deceptive, obscene, pornographic, terrorist, violent, harmful, privacy-infringing or child-endangering content.

AI Tools and SHAIKE Index. The entrant represents and warrants that all AI tools, datasets, outputs and licenses used for the film allow the submission, screening, promotion and platform uses permitted under these Rules. The entrant represents and warrants that the SHAIKE Index is accurate, complete and not misleading.

Indemnity. The entrant shall indemnify and hold harmless SHAIKE Film Festival, Firstdraft Media SARL, its partners and its team against any claim, action, notice, demand, liability, loss, damage, settlement, fine, penalty, cost or expense, including reasonable legal fees, arising from the film, the submitted materials, the entrant’s breach of these Rules, the entrant’s warranties, any rights clearance failure, any unlawful content, any inaccurate declaration or any third-party claim.

Suspension. SHAIKE may suspend screening, platform availability, promotion, selection or award attribution upon receipt of a credible claim, notice or legal risk.

Music and Sound Elements. The entrant warrants that all music and sound elements included in the film are fully cleared for submission, screening, online communication, promotion and platform use under these Rules.

Music Rights. This includes, where applicable, synchronization rights, master rights, publishing rights, neighboring rights, performer rights, producer rights, stock music licenses and rights relating to AI-generated music.

Cue Sheet. SHAIKE may request a cue sheet, license evidence or written clearance at any time.

Music Claims. The entrant remains solely responsible for any claim, royalty, fee, license cost or collecting society claim arising from the music or sound elements included in the film, except for mandatory obligations that applicable law places directly on SHAIKE as event organizer or broadcaster.

13. COMPLIANCE & DISQUALIFICATION

Fair Competition. Adherence to these rules ensures a fair field for every filmmaker. The festival enforces them at submission and throughout the competition.

Enforcement at Submission. Eligibility, runtime, format, technical, and clearance requirements are checked at submission. Non-compliant entries may be refused before judging.

Disqualification. SHAIKE may refuse, suspend, remove, geoblock, deprogram or disqualify any film at any time where the film breaches these Rules, creates a legal risk, creates a reputational risk, fails technical checks, lacks required rights, lacks required consents, is subject to a credible third-party claim, or is otherwise unsuitable for the Competition or public screening. Disqualification may occur before selection, after selection, before screening, after screening, before an award, after an award, or after publication. If an award has already been granted, SHAIKE may withdraw the award, request return of any trophy, remove laurels, amend public announcements and reassign or withhold the award.

No Refund. Entry fees are non-refundable in all cases, including non-selection, withdrawal, and disqualification.

14. KEY DATES

Attendance and Travel Costs. Attendance at the ceremony is not required to remain eligible unless SHAIKE expressly states otherwise in writing. SHAIKE does not cover travel, accommodation, visa, insurance, meals, production, delivery or attendance costs unless expressly agreed in writing. The entrant is solely responsible for obtaining any travel document, visa, authorization or insurance required to attend the festival.

Dates and Schedule Changes. The dates set out in these Rules are indicative. SHAIKE may amend the announcement dates, finalist dates, ceremony schedule, screening schedule, venue, format or publication timeline for operational, artistic, legal, technical or force majeure reasons. Any material update will be published on shaike.ai or communicated by email where appropriate.

15. INTELLECTUAL PROPERTY RIGHTS AND LICENCE

Competition Licence. By submitting a film, the entrant grants SHAIKE a free, non-exclusive, worldwide license to use the film and submitted materials for the purposes of administering the Competition, reviewing submissions, selecting films, organizing screenings, announcing selections, granting awards, promoting the festival, documenting the festival and maintaining festival archives.

Licensed Materials. This license covers the film, title, synopsis, logline, poster, stills, screenshots, trailer, excerpts, credits, director’s name, production information, SHAIKE Index declaration and any other material submitted by the entrant.

Licensed Rights. This license includes the rights to reproduce, store, host, encode, transcode, format, subtitle, translate, adapt for technical purposes, represent, screen, communicate to the public, make available, display, publish and share the licensed materials.

Licensed Media. This license applies to the SHAIKE website, SHAIKE platforms, SHAIKE social media accounts, newsletters, press materials, festival catalogues, laurels, trailers, reels, aftermovies, presentations, partner communications, media coverage, public screenings, professional events and festival archives.

Promotional Excerpts. For promotional purposes, SHAIKE may use stills and excerpts of the film up to three minutes or ten percent of the film runtime, whichever is shorter.

Short Films. For films under three minutes, SHAIKE may use excerpts up to thirty seconds.

Festival Screenings. For public festival screenings, SHAIKE may screen selected films in full during the festival and related festival events.

Full Platform Showcase. For Short Film, Music Video, Animation, Documentary, Short Drama, TV Pilot / Series Concept and Student Film categories, SHAIKE may showcase the full selected film on SHAIKE platforms and partner platforms for editorial, festival, promotional, archival and non-exclusive showcase purposes.

Feature Films. Feature Films are excluded from full platform showcase unless the entrant gives separate written consent.

Separate Agreement. Any commercial distribution, paid exploitation, sale, exclusive license, assignment or standalone monetized exploitation of a film requires a separate written agreement with the relevant rights holders.

License Term. The license is granted for five years from the submission date.

Territory. The license is granted for the whole world.

Archival Term. The festival archival license is granted for ten years from the submission date.

Sublicences. SHAIKE may grant sublicenses to technical providers, projection providers, hosting providers, press partners, media partners, sponsors and festival partners only to the extent necessary to perform the authorized uses under these Rules.

Ownership. All intellectual property rights in the films remain with their respective rights holders.

Moral Rights. Nothing in these Rules transfers or waives moral rights where such rights are inalienable under applicable law.

Technical Adaptations. To the fullest extent permitted by law, the entrant agrees not to object to technical formatting, subtitling, cropping, resizing, encoding, excerpting, festival branding, laurels, captions or promotional edits made in accordance with these Rules, provided that such use does not materially distort the film or harm the entrant’s honor or reputation.

Entrant Publicity. By submitting a film, the entrant authorizes SHAIKE to use the entrant’s name, pseudonym, biography, country, image, voice, interview, likeness and public statements for festival communication, press, promotion, award announcements, social media, aftermovies and archives.

Publicity Term. This authorization is free, non-exclusive, worldwide and valid for five years from the submission date.

Event Recording. SHAIKE may photograph, film, record and livestream the festival, the ceremony, screenings, talks, interviews and public events.

Event Image Rights. Entrants attending the festival authorize SHAIKE to use their image, voice, name and participation as captured during the event for festival, editorial, promotional, press and archival purposes.

Event Image Rights Term. This authorization is free, non-exclusive, worldwide and valid for five years from the event date.

16. PERSONAL DATA

Data Controller. Firstdraft Media SARL, operating under the SHAIKE name and brand, acts as data controller for personal data processed in connection with the Competition.

Processing Purposes. Personal data is processed for submission management, eligibility verification, rights verification, communication with entrants, selection, jury review, programming, screening, award administration, fraud prevention, legal compliance, accounting, dispute management, festival promotion and festival archives.

Legal Bases. The legal bases are performance of these Rules, SHAIKE’s legitimate interests, compliance with legal obligations and, where required, consent.

Recipients. Personal data may be accessed by SHAIKE, its authorized team, jury members, pre-selection committee members, technical providers, payment providers, hosting providers, legal advisors, festival partners and public authorities where required by law.

Transfers. Personal data may be transferred outside the European Economic Area where necessary for the Competition, subject to appropriate safeguards where required by applicable data protection law.

Retention. Personal data relating to submissions is retained for three years after the last interaction with the entrant, unless a longer retention period is required for legal, accounting, evidentiary, archival or dispute-management purposes.

Data Subject Rights. Entrants may exercise their rights of access, rectification, erasure, restriction, objection and portability, and may lodge a complaint with the CNIL or any competent supervisory authority.

Privacy Policy. Further information is available in the SHAIKE Privacy Policy.

Human Decisions. Selection and award decisions are made by humans.

No Solely Automated Decision. SHAIKE does not make decisions based solely on automated processing that produce legal effects concerning entrants or similarly significantly affect them.

17. FORCE MAJEURE, LIABILITY AND FRAUD

Force Majeure. SHAIKE is not liable for any delay, modification, interruption, postponement, relocation, online conversion, cancellation, technical failure, venue unavailability, platform failure, cyberattack, strike, administrative restriction, public health measure, force majeure event or event beyond its reasonable control affecting the Competition, the festival, screenings, announcements, platforms or awards.

Festival Changes. In such circumstances, SHAIKE may modify the schedule, change the venue, replace the screening format, organize online screenings, postpone the ceremony, reduce the program, cancel a category or cancel the Competition.

No Compensation. No such measure entitles entrants to compensation for production costs, travel costs, accommodation costs, visa costs, opportunity loss, loss of visibility, loss of chance or indirect damages.

Liability Exclusions. SHAIKE is not liable for non-selection, category reassignment, disqualification, non-screening, limited screening, schedule changes, platform unavailability, techssnical failure, loss of data, loss of opportunity, loss of reputation, loss of profits, loss of chance or indirect damages.

Liability Cap. SHAIKE’s aggregate liability under these Rules is limited to the entry fee actually paid by the concerned entrant for the concerned film, except in case of fraud, willful misconduct, bodily injury or liability that cannot be limited under applicable law.

Fraud and Integrity. SHAIKE may cancel, shorten, suspend or modify the Competition if fraud, attempted fraud, technical abuse, platform manipulation, false identity, rights misrepresentation or abnormal submission behavior affects the integrity of the Competition.

Legal Action. SHAIKE may take legal action against any entrant or third party involved in fraud, attempted fraud, rights misrepresentation or technical manipulation.

18. GENERAL TERMS

Technical Standard. Every entry must meet a minimum technical standard of High Definition (HD) resolution.

Contractual Framework. Submission to the Competition through shaike.ai is governed by these Rules and the SHAIKE Terms of Use. Personal data processing in connection with the Competition is described in the SHAIKE Privacy Policy.

Rules Prevail. In case of conflict between these Rules and the SHAIKE Terms of Use regarding the Competition, these Rules prevail.

Privacy Policy. The SHAIKE Privacy Policy is provided for information purposes in accordance with applicable data protection law. In case of conflict between these Rules and the SHAIKE Privacy Policy regarding personal data, the SHAIKE Privacy Policy prevails, unless these Rules provide more specific information for the Competition.

Sponsors and Festival Partner Requirements. SHAIKE may enter into agreements with sponsors, institutional partners, media partners, technical partners or platform partners before or during the Competition. The entrant agrees to comply with any reasonable additional requirement imposed by such partners. Failure to comply with such requirements may result in the withdrawal of the affected benefit, screening, platform availability, partner opportunity or award eligibility, without refund or compensation.

Severability. If any provision of these Rules is held invalid, unlawful or unenforceable, the remaining provisions remain valid and enforceable.

Survival. The provisions relating to intellectual property, image rights, warranties, indemnity, disqualification, personal data, liability, governing law and jurisdiction survive the end of the Competition.

Amendments. SHAIKE may amend these Rules where necessary for legal, technical, operational, artistic, security, platform, venue or regulatory reasons.

Material Amendments. Material amendments will be published on shaike.ai.

Effect of Amendments. Amendments do not affect rights already granted to SHAIKE for validly submitted films, unless required by mandatory law.

Governing Law. These Rules are governed by French law.

Jurisdiction. Subject to mandatory consumer protection rules and mandatory jurisdiction rules applicable to entrants, any dispute relating to the validity, interpretation, performance or termination of these Rules shall fall within the jurisdiction of the competent courts of Paris, France.

Language. These Rules are drafted in English. A French version may be published for legal and administrative purposes. In case of discrepancy between the English version and the French version, the French version shall prevail once published. Until a French version is published, the English version is binding.
